Japanese Online Talk Terms of Use

Article 1: General

Welcome to Japanese Online Talk of User Centered Design Inc.(Business address: TFT Building. East Wing 9th Floor-INQ5 3-1 Ariake, Koto-ku, Tokyo, Japan).
Japanese Online Talk (referred to herein as JOT) is an online education site for teaching and learning Japanese, especially who wants to practice Japanese conversation through web-based lessons. People who want to enroll in JOT's courses (referred to herein as “Enrollees”) shall be bound by these terms. So please read these terms of use carefully and fill in the Enrollment Form only if you accept them.

Article 2: To Reach an Agreement

After reading and agreeing to these terms of use from JOT' s homepage, you need to fill in all the required fields of Enrollment Form (sent-via-email form) and send to us. Your registered information will be checked and accepted if any of the required fields are not missing. Then, an agreement of using this site will be made between you and User Centered Design INC.

Article 3: Requirements for Using JOT

Enrollees are required to fulfill the following terms:

1. In order for us to process lessons, we need you to provide us your purpose of learning.
2. You acknowledge that you will be imposed on financial obligations after enrollment.
3. If your registration is accepted, you are required a proof of your identification documents (for example: driving license, passport, student card, staff card, etc…) and you acknowledge that your photo will be presented in our site and attached to downloadable Enrollment Form.
4. If your registration is accepted, you shall have an approved person to assure this.
5. You assure that you lawfully possess or obtain necessary software or internet accessibility so that JOT's lessons can be carried on without any hitch.
6. You agree to be bound by these Terms of Use.

Article 4: JOT's Services

1. We provide you a range of computer-based learning from Japanese conversation skills to other related knowledge.
2. Except those mentioned above, we will take into consideration of your proposed approaches of teaching and learning Japanese conversation.

Article 5: Change or Delay of Lesson or Course

1. The content of lessons or courses may be changed under some circumstances.
2. JOT's lesson or course shall be changed or delayed in the following cases:
   1. Teacher could not attend the course due to his or her personal problems.
   2. In case of emergency such as natural disaster…

Article 6: Purchase the Lesson Ticket

Lesson fee, on principle, has to be paid in full through the following methods within 7 days from the commencement of agreement mentioned in Article 2.

1. Transfer to our bank account.
2. Use PayPal

To use PayPal services, your personal information shall be collected, used, protected or stored in accordance with the Security and Privacy Policy of PayPal.

Article 7: Lesson Fee and Details

For details of lesson fee, please fill in “Confirmation of Enrollment (E-mail)”.

Article 8: About Cancellation and Cooling-off Period

If you want to cancel the enrolled course, you have 8-day cooling off period, started from the day we send you the confirmation email to notify of your logging in information such as ID, password.
In case of cancellation, please send to our office the letter of “Requirement for Cancellation”. Course cancellation shall be processed after confirmation with the enrollee.

Article 9: Prohibited Use of JOT's Software and Materials

Using the services of JOT, you are subject to the following restrictions and prohibitions on use. If you violate any of these, we may terminate your account and your ability to use JOT immediately.
And you must be liable for damages, losses resulting from or relating to any such prohibited use of JOT.

1. Act of violence or sabotage including threat.
2. Drug abuse.
3. Use the services for other purposes which are not same as JOT's purposes such as political or religious activities. In this case, please contact the person in charge of JOT.
4. Action that imposes on honor, prestige or order of our company.
5. Transferring, leaking, disclosing or selling our processes, property, device, technology, know-how, secret, etc… on purpose.
6. To tamper with, reproduce software of JOT unlawfully for your own use or selling.
7. To tamper with, reproduce images, animations, pictures which was used for lesson unlawfully and transferring or selling them.
8. Transferring, leaking or selling part or whole of information relating to individual curriculum of JOT's.
9. Act of sabotage such as unlawful invasion, information interference, and virus distribution to JOT site.
10. Taking pictures, recording, distributing or selling without JOT's permission.
11. Investigation targeted at JOT for the purposes of your own business or business of other e-learning schools, Japanese Conversation Schools and/or people who are relating to these.
12. Besides above-mentioned terms, any act of use was not originally intended to learn as JOT's purpose.

Article 10: Termination of your account

Your account will be terminated without fee refund and your further enrollment will be refused if you have any of actions listed below:

1. Breaking the JOT rules and continue doing this in despite of our warning.
2. Currently being subject to prosecution for serious violation of laws.
3. Have not made payment for lesson fee.
4. Be impossible to attend lesson due to sickness, accident, disappearance or other reasons.
5. Evade responsibility towards media which is used keeping record of lesson.
6. Tamper with recorded data which you obtained from media recording lesson.
7. Provide incorrect or false information when registered.
8. Commit any of prohibited use mentioned on the Article 12.

Article 11: Procedure of account termination

In case of termination, you will lose all the rights to use JOT site.

Article 12: Delay of Use due to JOT or Act of Gods

Regarding to the purchased tickets, the registered lessons or the uncompleted attending lessons are delayed or stopped because of our inconvenience or act of Gods, we will refund part of lesson fee equal to part of unfinished lesson upon your request. At that time, responsibility of JOT ends without any dispute.

Article 13: Jurisdictional Issue

In the event of any dispute or contradiction which is not mentioned in these Terms of Use, both parties will deliberate on suitable resolution or forwarding the case to the Tokyo District Court in accordance with Japanese laws.

Article 14: Others

Any term which is not mentioned in these Terms of Use, shall be solved in accordance with civil law or/and other current regulations. However, you should read the following notices.

1. We shall not concern personal affairs or trouble which is between enrollee and related person of JOT.
2. We shall not be liable for disclosure of your information and related person of JOT in case of protection of our privacy.
3. Personal information, which is not intentionally displayed on JOT, may be leaked or obtained by other users and we shall not responsible for this.
4. Lesson's image may be opened to public by third party with your permission.
5. This Terms of Use may be altered if it is necessary to do so.
